ANNUAL WAGE NOTICES DUE FEBRUARY 1

Recent changes to the New York State Labor Law eliminate the requirement to provide a wage notice annually. Dealers must continue to provide a wage notice annually. Dealers must provide a wage notice to every new employee at the time of hire. When must the notice be given to employees? • At the time the employee is hired • Annually, between January and February 1. Repealed

Which employees should get a form? • Every employee must get a form.

What information has to be on the form? • Dealership Name (including DBAs)

• Regular Rate of Pay

• Dealership Address • Telephone Number

• Overtime Rate, if Applicable

• Regular Payday

Must I retain completed forms? If yes, for how long? The signed forms must be kept on file for six years.

What is the penalty for not giving proper notice? Penalties have increased up to $5,000 per employee for failure to provide the notice.
