SECURE POWER OF ATTORNEY FORM USE

A recurring problem facing dealers is that a customer with a missing title trading in a vehicle often fails to return to sign a duplicate title. To address this issue and meet dealers’needs, GNYADA worked with the DMV to create the MV-93 Secure Power of Attorney form. The MV-93 authorizes the dealer accepting the trade-in as the attorney-in-fact for the purpose of odometer and damage disclosure and signature on a title. This eliminates the need for the customer to return to the dealership to sign the duplicate title.

When did the New MV-93 go into effect: For any sale dated on or after May 22, 2015, only the DMV-issued Secure Power of Attorney Form (MV-93) may be used by a dealer to sign the title on behalf of the selling owner and record the odometer reading. The DMV will not accept forms “homemade”by the dealer. How to order the New MV-93: Dealers must order the Secure Power of Attorney Forms (MV-93) directly from DMV. The forms are available in packages of 25 and cost $125.00 for each package. The form can be downloaded at: http://dmv.ny.gov/forms/mv931.pdf Dealers may pass along the $5 fee for a Secure Power of Attorney Form to a customer who is trading in a vehicle or to a customer buying a trade-in. The $5 charge must be listed separately on the invoice, with the disclaimer “THIS IS NOT A DMV FEE.”
