REPORTING DEADLINES EXTENDED: NYC DEALERS MUST SUBMIT 2019 ENERGY AND WATER BENCHMARKING

NYC dealers who own buildings (e.g., dealerships, maintenance garages, car washes, fully - covered garages, owned storage spaces, and administrative buildings) larger than 25,000 sq. ft. of floor space (multiple stories all count), or who own a tax lot with multiple buildings with the total floor space of more than 100,000 square feet, must report energy and water use to the City annually.

New Deadlines: 2019 data must be submitted by May 1, 2020.

If you received a compliance notification from the New York City Department of Finance, this law applies to you. If you aren’t sure if you received a notification, check the Covered Buildings List for Benchmarking Compliance in 2020 found on the NYC Benchmarking website page. www1.nyc.gov/site/buildings/business/ benchmarking.page. How to Report The City uses the USEPA’s Energy Star Portfolio Manager as the tool to collect all the energy and water information. • If this is your first time reporting, create a location - specific Energy Star Portfolio Manager Account. • Input location - specific information, like the building - use, size, and if there are multiple buildings on-site. • Collect your building’s energy and water use data from https://a826 - amr.nyc.gov/mydepaccount/ or the utility providers. “Energy”includes electricity, natural gas, fuel oil, and steam. • Upload energy and water data into your Portfolio Manager Account. The deadline to submit 2019 data was May 1, 2020. Failure to submit a Benchmarking report by this date will result in a $500 penalty. Continued failure to submit will result in an additional $500 fine for every quarter that the deadline is missed. Every year the deadline to submit is May 1st, but due to the pandemic, there is an extension until August 1, 2020 to submit without receiving a notice of violation. Whoever did not submit by May 1st should receive a notice of non-submission giving them until August 1st to submit. Record Retention Dealers must retain documents regarding their building’s energy and water consumption for a minimum of three years.
