WESTCHESTER COUNTY EARNED SICK LEAVE

• Effective April 10, 2019, Earned Sick Leave provides covered employees working for an employer with 5 or more employees with up to 40 hours of paid sick time per year. • A covered employee working for an employer with fewer than 5 employees may earn and use up to 40 hours of unpaid sick time per year. Eligible Reasons for Leave: • Treatment for illness, injury, or a health condition • Preventive medical care • Care for a family member with illness, injury, or who needs preventive medical care • Closure of business or schools due to a public health emergency

Covered Employees: Individuals who work more than 80 hours in a calendar year

Rate of Accrual: 1 hour/30 hours worked accrual of sick leave begins on July 10, 2019, or on the employee’s date of first employment, whichever is later. Unused leave can carry over into the next year with a maximum of 40 hours per year.

Earned Sick Leave is compensated at employee’s regular hourly rate.

Notice Required To Take Earned Sick Leave • Employees may request earned sick time orally, in writing, or by electronic means • No Timing Requirement: Employees only need to make a good faith effort to provide notice in advance • Dealers may specify notice procedures in the written policy • Dealers cannot require employees to find a replacement to work during employee’s absence
