Scenario: Due to a clerical error, the wrong vehicle, of the same make and model as the intended vehicle, is registered and titled to a customer. So, the paperwork the customer has is not the paperwork for the car they’re presently driving. How does the dealership fix this? YOU’VE REGISTERED / TITLED THE WRONG VEHICLE — NOW WHAT?

First, confirm which vehicle the customer has in their possession. Ask the customer to record the VIN on the dashboard of the car they currently have, and report that to the dealership. If the customer has the wrong vehicle but the right paperwork, they will need to swap cars back at the dealership. Billers must notify the DMV (or their DMV service provider) that the customer is exchanging vehicles. On their end, DMV will update their system to note the vehicle the customer was wrongly driving and transfer that VIN record (for the period of time when the customer had possession of it) to the correct vehicle. If the customer is in possession of the vehicle they intended to buy, they and the dealership need to generate the correct paperwork. In order to do this, the following materials must be packaged and sent to the dealership’s DMV service provider or directly to the DMV (wherever dealership work is processed): • The correct MV-50 and MV-82, with original signatures for both the customer and the dealership. (The customer will need to return to the store to re-sign.) • An Insurance ID card for the correct vehicle, with the original dates. • A letter on dealership letterhead, detailing the issue: - Identify the vehicle (year, make, VIN) that was incorrectly registered and titled.

- Identify the vehicle that should have been registered and titled. - Note if the customer needs to return the original Title. - Include a $10.00 check payable to “Commissioner of Motor Vehicles” for the original MSO or Title to be returned. • If the correct vehicle weighs more than the incorrect vehicle, include another check (payable to the “Commissioner of Motor Vehicles”) to cover the additional registration fees. If the customer’s original Temporary Registration is still valid, the dealership can issue the temp from the corrected MV-50 with the original dates on it. If the Temporary Registration is expired, contact the DMV (or service provider) to have Albany issue an extended temp, with the correct VIN, to the customer.

We announce the following correction to the November 2016 issue of DMV-DIRECT News: In the article Proper Procedure for Accepting a “Returned” Vehicle (under “Time-Saving Tips”), the form customers must complete to have titles returned to the dealership is the MV-93 (secure power of attorney).
