Dealer Obligations • Must reinstate earned sick time if a separated employee is rehired within 9 months • May require documentation from a healthcare providers for earned sick leave of more than 3 consecutive workdays

• Cannot require providers to specify medical reason for leave • Cannot interfere with, restrain, or deny use of Earned Sick Leave • Cannot retaliate or discriminate for use or discussion of Earned Sick Leave • Must retain records documenting earned sick time hours accrued and used for 3 years

Westchester County’s Earned Sick Leave Law is enforced by the Department of Weights and Measures – Consumer Protection • An employee may file a complaint within 1 year of alleged violation • The Department must investigate complaints and attempt to facilitate a resolution upon finding probable cause • The Department may hold a hearing to resolve the complaint if no resolution is reached
