Waste Fee Reminders

Make the Most of Your GNYADA Membership As members of the Greater New York Automobile Dealers Association, dealers have access to a wealth of services and programs aimed at keeping their busi- ness operations compliant, efficient, and profitable. The below programs are just a few of the crucial business services that GNYADA provides to its members: 19

The Association regularly receives questions about when dealers may charge fees for environmental waste disposal. DMV permits deal- ers to charge for the disposal of waste materials, with the exception of motor oil, batteries, and tires. Any disposal charges for other waste products (antifreeze, brake fluid, sealants, etc.) must be clearly identified and itemized in all esti- mates and repair orders. Dealers may not use preprinted fees or per- centage based fees. Motor Oil: State Law prohibits deal- ers from charging for accepting waste oil. Dealers must take up to five gallons of used oil per day from an individual and must con- spicuously post a sign stating: We Accept Used Oil for Recycling at No Charge. Batteries: NY law requires retailers to accept up to two batteries per month per individual at no charge. Again, a conspicuous sign is required and must state: It is illegal to discard vehicle batteries. State law requires us to accept vehicle batteries at no charge for recycling. Tires: Dealers may not charge for accepting waste tires that are simi- lar in size and quantity to the num- ber of tires purchased by the cus- tomer. The State requires sellers of new tires to collect a $2.50 Waste Tire Fee for every new tire sold, to cover their future recycling cost. These charges must also be item- ized in all estimates and R.O.s, and an official sign must be posted. GNYADA offers required disposal signs to members, free of charge. To order, call 718.746.5900.
