Dealers should track all hours worked by their employees, including meal periods. Employees should be instructed to clock out and in, to and from lunch, to properly record actual hours worked. New York Labor Law states that all employers, including automobile dealers, must provide employees who work six or more hours per day with an uninterrupted meal period of at least 30 minutes between the hours of 11am and 2pm. Employees who work longer shifts that begin before 11am and continue past 7pm are entitled to an additional meal period of at least 20 minutes between 5 and 7pm. Is it ok for employees to eat lunch at their desks? No. Managers sometimes permit staff to take lunch at their desks so that they can answer the phone, catch up on paperwork, take an “up” or com- plete a buyer’s order over a sand-
