460. Legislative findings The legislature finds and declares that the distribution and sale of motor vehicles within this state vitally affects the general economy of the state and the public interest and the public welfare, and that in order to promote the public interest and the public welfare and in the exercise of its police power, it is necessary to regulate motor vehicle manufacturers, distributors and factory or distributor representatives and to regulate dealers of motor vehicles doing business in this state in order to prevent frauds, impositions and other abuses upon its citizens and to protect and preserve the investments and properties of the citizens of this state. 461. Short title This article shall be known and may be cited as the “franchised motor vehicle dealer act”. FRANCHISEd MOTOR VEHICLE DEALER Act VTL Article 17-A (EFF.1/1/12) 1. “Distributor” means any person who primarily offers, sells or distributes new motor vehicles to franchised motor vehicle dealers or maintains distributor representatives within the state. 2. “Distributor branch” means a branch office maintained by a distributor which offers, sells or distributes new motor vehicles to franchised motor vehicle dealers in this state. 3. “Distributor representative” means a representative employed by a distributor branch or distributor. 4. “Factory branch” means a branch office maintained for directing and supervising the representatives of the manufacturer or which office is maintained for the sale of motor vehicles. 462.
