Accrual Rate Employees accrue sick leave at a rate of at least 1 hour for every 30 hours worked (this is the same rate set for New York City’s Earned Safe and Sick Leave Law and for Westchester’s Earned Sick Leave Law).

HOT TOPICS 2021 MEMBERSHIP DIRECTORY & SERVICES GUIDE Dealers can also comply by providing employees with their total sick leave allotment at the beginning of each year. However, if you frontload sick leave, you cannot reduce or deduct any unused sick leave at the end of the year.

Rate of Pay Employees must be compensated for their paid sick leave at their regular rate of pay or minimumwage, whichever is greater. Leave Increments Dealers may set leave increments for the use of sick leave (e.g., 15 minutes, 1 hour, etc.) but may not set the minimum increment at more than 4 hours. Dealers are permitted to limit the leave taken in any year to the maximum amount required to be provided to such employee (e.g., 40 hours for midsized employers and 56 hours for large employers). Any limitations permitted by the law must be put into writing and either posted or given to employees. Dealers must notify employees in writing or by posting a notice in the worksite, prior to the leave being earned, of any restrictions in their leave policy affecting the employees’ use of leave, including any limitations on leave increments.

Record Retention Dealers are required to keep records showing the amount of sick leave provided to each employee under the law and such records must be maintained for a minimum of six (6) years. Employees can ask for a summary of the amounts of sick leave accrued and used by the employee in the current calendar year and/or any previous calendar year. Dealers must provide the summary to the employee within three business days.
