SINGLE-OCCUPANCY BATHROOMS – MUST BE GENDER NEUTRAL
On December 23, 2020, Governor Cuomo signed amendments to the NYS Civil Rights and Education Laws requiring all single-occupancy bathrooms in New York State located in public places, which includes public bathrooms in businesses like auto dealerships, must be gender-neutral. The new law closely follows a similar requirement enacted by New York City in 2016. Businesses with single occupancy bathrooms accessible to the public were required to comply by March 23, 2021. Redesigning or Constructing New Bathrooms Is Not Necessary Businesses are not required to redesign existing bathroom facilities or construct new gender-neutral, single- occupancy restrooms, instead, dealers must remove any signage designating the bathroom as“male”or“female” and replace it with signage indicating it is “gender neutral for use by no more than one occupant at a time or for family or assisted use open to people of all genders.”

A “single-occupancy bathroom” is defined as “a bathroom intended for use by no more than one occupant at a time or for family or assisted use and which has a door for entry into and egress from the bathroom that may be locked by the occupant to ensure privacy and security.” Change the Sign Dealers should ensure that single- occupancy restrooms are clearly designated as gender-neutral.
