The Health and Safety Plan First, the law mandates that all employers must adopt an industry-specific written plan to prevent airborne infectious diseases in the workplace. The New York Department of Labor (NYDOL) is responsible for creating model safety plans. Dealers will be required to have their plan in place within 30 days of the release of the model templates. All workplace plans must include the following: • Health screenings • Face coverings • Personal Protective Equipment (PPE) • Hygiene stations • Regular cleaning/disinfecting • Social distancing • Safety compliance monitor(s) Dealers will also be required to post notices about the plan and train staff. Dealers will have to notify all employees in writing, new employees at the time of hiring, and when employees return to work following a closure for infectious- disease related closings. Establishing a Workplace Health and Safety Committee Additionally, the lawmandates that employers allowemployees to establish a joint employer-employeeworkplace health and safety committee authorized to raise health and safety issues and evaluate workplace health and safety policies. Dealers must allow employees to form such a committee by November 1, 2021. The committee would be empowered to: • Raise health and safety concerns which the employer must respond. • Review any workplace policy relevant to the HERO Act and provide feedback to the employer. • Review the adoption of any policy in the workplace in response to any health or safety law, ordinance, rule, regulation, executive order, or other related directive. • Participate in any site visit by a government regulator. • Review any report filed by the employer related to the health and safety of the workplace. • Conduct committee meetings at least once per quarter.
