What kind of notice is the dealer required to provide to employees? Dealers must display a poster in a conspicuous place that states: that any and all telephone conversations or transmissions, electronic mail or transmissions, or internet access or usage by an employee by any electronic device or system, including but not limited to the use of a computer, telephone, wire, radio or electromagnetic, photoelectronic or photo-optical systems may be subject to monitoring at any and all times and by any lawful means. Dealers must provide written notice to new hires: Dealers must provide a written notice to new employees informing them of this policy. These employees are required to sign an acknowledgment of receipt of the notice. These notices can be provided and acknowledged electronically. Does my dealership have to post and provide the notice to new employees if my dealership does not monitor my employees? No, if your dealership does not electronically monitor employees then you are not required to provide employees with notice. Does my dealership need to keep copies of signed acknowledgement forms? Yes. Retain copies in the employee’s personnel file and keep a general record with the names of employees who were provided notice, acknowledged receipt of the notice, and the date of the acknowledgement. What are the penalties? $500 for first offense, $1,000 for second offense, and $3,000 for third and subsequent offenses. The Attorney General is responsible for enforcing this law.
