Agreement Signals Truce in So-called Right-to-Repair Battle

The Alliance of Automobile Manufacturers, the Association of Global Automakers, the Automotive Aftermarket Industry Association and the Coalition for Automotive Repair Equality recently signed a Memorandum of Understanding (MOU) that is intended to call a truce over the so-called Right to Repair legislation. The MOU signed by the various groups is based on a recent law final- ized in Massachusetts (Chapter 165 of the Acts of 2013) and extends the essential provisions of the Massachusetts law nationwide. Governor Cuomo signed on to participate in a multi-State agreement to increase the number of ZEV’s to 3.3 million vehicles on the road by 2025. New York joined 7 other states including; California, Oregon, Connecticut, Maryland, Massachusetts, Rhode Island, and Vermont. Each State will need to come up with a strategy that will increase ZEV sales in their respective state. To further this effort, Governor Cuomo has requested that GNYADA be part of a working group involved in formulating a plan of action on how this can be accomplished such as incentives to create electrical charging stations and hydrogen fuel- ing stations to support such vehicles. The working group will also evaluate sales and tax incentives for buyers and dealers while also considering non-monitary benefits This national agreement indicates that the various industry signatories will focus on opposing individual state legislation while ALL groups will work to fully implement the MOU. It should be noted that neither NADA, nor any state dealer associa- tion, is a party to the agreement and the agreement does not address cer- tain dealer-protective provisions that were incorporated into the Massachusetts statute. It is unclear whether or not this agreement will are currently members of the signatory associations have agreed to adhere to the agreement.

And it is unclear at this time whether the MOU offers adequate protection to dealers in their unique role as exclu- sive authorized warranty and safety recall service providers. GNYADA will keep dealers informed of the specific impact the agreement will have on New York auto retailers as the various groups work to imple- ment the MOU.

The working group will include the DMV and the Department of Environmental Conservation and other Dealer Associations throughout New York State. GNYADA is committed to ensuring that dealers’ needs are met in the development of the ZEV program. Currently, sales of ZEV’s are counted when an OEM delivers them to deal- ers – even when they are not sold to a retail buyer. One of our goals will be to change that measurement to only count sales to retail or fleet customers. Education and outreach campaigns will be created to high- light the benefits of ZEV’s and increase their use.

New York City’s Right-to-Know (RTK) annual filing is due March 1st. All dealers that use, store, process, or handle any substance on NYC’s list of Hazardous Substances must file a Facility Inventory Form (FIF) with the NYC Department of Environmental (DEP) by March 1st.
