Everything

is covered, from navigating the regulatory maze to saving money through our Dealer Discount Club. The past twelvemonths have been an incredible year in our Association’s history. At the end of 2015, we celebrated the 10th Anniversary of the opening of the Center for Automotive Education & Training, where we focused on the thousands of men and women who have come through our doors and now enjoy great jobs in the auto industry. We also reached an incredible 20-year milestone with our DMV-DIRECT titling and registration service. Three million registrations and counting! Both these occasions highlighted the ongoing, long-term commitment of our 106-year-old Association to the dealers of greater New York. Please take time to look through your new Membership Directory. AUTO DEALERS: BUILDING A BETTER FUTURE

Automobile dealerships are the economic engines of the local communities inwhich they reside.The entrepreneurs who run themare job creators, investors in the community, and generous charitable contributors to local hospitals, fire departments, little leagues, and more. The Greater New York Automobile Dealers Association is dedicated to supporting this important group of community-based businesses. GNYADA’s mission is to promote excellence in business practices, ethics, standards and service among franchised new car dealers for the benefit of both the industry and customers; to encourage, the passage of positive legislation and the creation of a cooperative regulatory atmosphere at all levels of government. The Association is dedicated to providing education and training to the retail automotive industry workforce, and assisting in the marketing, sales and service of automobiles in the greater New York area.

ABOUT GNYADA

Information is Key GNYADA works to keep its dealer members informed about important issues, trends and regulations within the franchised new car marketplace. In addition to influencing legislation, the Association continually provides dealers with compliance solutions, newsletters, seminars, and invitations to Association events, special members-only offers, as well as many other benefits that support the needs of our members and the communities they serve. One-Stop-Shop Assistance GNYADA’s Dealer Hotline provides dealers with fast answers to tax inquiries, employment issues, and other dealer matters. GNYADA’s Field Service Representatives will visit member dealerships at least twice a year. During visits, members stock up on complimentary compliance signs and posters, DMV forms, and other useful items.The field teamwill also perform a complete walk-through of the dealership, informing dealers of potential EPA, OSHA, and OSHA and Privacy Act violations.

Advocating On Dealers’ Behalf GNYADA works to protect and promote franchised auto dealerships’ interests before local, state, and federal legislators. The Association monitors hundreds of bills each year, conducts dozens of meetings with state and local legislators, and promotes issues that affect the automotive retail industry, including matters such as auto insurance, tax, recalls, advertising regulations and brokers issues.

Keeping Dealers In Compliance New car dealers are responsible for more than simply facilitating vehicle transactions for the public; they’re also required to comply with numerous federal, local and state regulations on a daily basis. To assist dealers with this ongoing challenge, GNYADA provides its members with comprehensive educational programs and practical reference guides covering key state, local and federal regulatory issues.

New York International Auto Show: Iconic NYC Event Celebrates 116 Years The New York International Automobile Show is the tristate area’s largest and most important automotive marketing event. The Show reaches an international audience, but its primary purpose is to excite potential vehicle buyers in the greater New York area about the new cars and trucks that are available in dealerships. Thanks to incredible media coverage, high profile vehicle introductions, unsurpassed industry events and the use of innovative social media marketing strategies,

the Show reaches the maximum number of potential car buyers, influencers, and opinion formers in our area. Universally hailed as one of the most impressive in the Show’s 116-year history, it is impossible for potential car buyers to miss the news that the Auto Show was in town.

An Event to Benefit Individuals Pursuing AUTOMOTIVE EDUCATION

GNYADA’s Annual Charity Golf Outing Every year, more than 400 dealers, allied members and other guests participate in GNYADA’s Charity Golf Outing, raising money to provide scholarships for students interested in entering the retail automotive industry. Last year, the Association distributed $25,000 at the Golf Outing amongst five highly deserving automotive technology students. Four of those candidates, including two US Army veterans, were enrollees at Lincoln Technical Institute — the fifth was a winner at the 2015 New York Automotive Technology Competition. The must-attend event takes place at the prestigious OldWestbury Golf & Country Club on Long Island.

GNYADA receives inquiries from dealers seeking assistance on a wide variety of topics. Questions range from ”Is my dealership required to disclose the prior use of a vehicle?,” “Can my customer export this car to a foreign country?,” to “Are e-cigarettes permitted in the shop?” The Association’s team offers compliance help with OSHA regulations, DMV requirements, Red Flags Rule policies, as well as hundreds of other topics. Most often, we can resolve our members’ issues immediately. However, if the problem is more complex, Association staff conducts research in-house or reaches out to experts or the appropriate agencies.

Field Services GNYADA’s Field Services team keeps dealers aware of current and pending issues. Our field reps have been recruited to cover the full breadth of our territories, from out in Eastern Long Island, all the way up to Dutchess, Orange and Putnam counties. They assist local dealers daily, keeping them updated with the information they need to run their businesses. This personal contact helps ensure our programs are relevant to dealers and their employees.

During visits,members stock up on complimentary labor, service and shopposters. DMV forms, seminar registration materials, and other useful items are available through our field team. Representatives may also complete a walk- through of the dealership, inspecting each area for potential EPA, OSHA, and Privacy Act violations as well as proper signage.

Dealership Compliance Dealers face a myriad of state and federal laws regulating their dealerships. Even keeping proper records can be complicated. GNYADA offers dealers compliance solutions through educational seminars, webinars and workshops in addition to providing other hands-on reference compliance materials. Throughout the year, GNYADA gathers industry specialists to hold educational seminars that help members comply with often complicated regulations affecting every aspect of dealership operations. Covered topics include sales tax rules, privacy, identity theft, OSHA’s Hazard Communication, franchise law and employment law. GNYADA also hosts special regional programs for our northern and east end dealers.

Dealer Facility Licensing GNYADA also assists dealers through the arduous licensing/amendment process. Operating franchised dealerships in NewYork requires dealers to follow numerous DMV, tax and other rules and requirements. Additional paperwork is needed when operating in New York City limits. Completing the application correctly and attaching the proper documentation and fees is mandatory; GNYADA’s experience and contacts help us guide both first-time New York dealers as well as established dealers through the system. Surety Bonds New York State Department of Motor Vehicles Law Section 415 requires new car dealers to have a $50,000 surety bond to secure or maintain their facility licenses. The Association assists dealers with surety bonds, out-of-state bonds, DCA bonds, Utility bonds, Games of Chance Bonds, ARISA Bonds and others. The 2014 amendments to the Franchise Law allows dealers to improve their bottom line through the exclusion of maintenance items from the calculation. GNYADA has a program to assist dealers prepare and submit compliant requests for increased reimbursement. Each manufacturer has different requirements and each submission is tailored to the specific brand. This program continues to be very successful in obtaining increased payments for warranty work to members.

Government Relations - Advocacy for Franchised New Car Dealers GNYADA’s experienced team understands that compliance with the laws and regulations for operating new car dealerships in the NewYork metropolitan area is challenging. Dental Insurance – Plans can offer coverage in-network only or can be combined to offer out-of-network coverage to accommodate your employees. Going for dental checkups at least twice a year can help prevent expensive procedures later. Most dental plans, preventive procedures are covered at 100%. Vision Plans –This is a relatively inexpensive benefit, but an important one. Studies have shown that most workplace errors are made by employees who should be wearing glasses but don’t, since they are not covered by a vision plan. Life Insurance –Most group life insurance plans will offer a guaranteed issue amount, even if an employee has an existing medical condition. It is one of the best ways to obtain Life Insurance at a cost that is less expensive than an individual policy. Members can choose from Term, Universal or Whole Life Products. DBL – Mandatory NYS Disability offers coverage up to 26 weeks with a maximum weekly payment of $170 which is taxable. Many employers look to enhance this benefit with a short-term disability benefit, and some opt to add a long-term disability plan to maximize coverage. Voluntary Benefits – These plans are individual but are offered through a group plan. They are normally paid 100% by the employee. Most can be on a pretax basis. They are: • Specific Disease – This coverage— for cancer, for example—helps pay for both medical and non-medical expenses. • Short-Term Disability – Pays for expenses while the employee is unable to work. • Accident – Benefits depend on the type of accident incurred. • Hospital Confinement – This protects against out of pocket expenses, such as, deductibles and copays, which are associated with a hospital stay. • Life Insurance – Term or Universal. Term is the least expensive type of Life Insurance while Universal is more costly but builds up cash value. You decide which one meets your needs. Long-Term Care – Provides assistance when an individual can no longer perform the activities of daily living. Benefits can be received as an inpatient or at home. Pet Insurance –As a member of GNYADA, you are entitled to a group discount of 10% and receive an additional 10% if you need to cover multiple pets. Flexible Spending Accounts – Allows employees to set aside a percentage of their pay on a pretax basis for eligible medical expenses ($2,550/yr.), dependent care ($5,000/yr.), parking ($250/mo.), and transit ($130/mo.). Automotive Youth Education Systems Through The Greater New York Automobile Dealers Association’s AYES Program, high school automotive technology students are given guidance to explore rewarding automotive careers. The GNYADA AYES Program fosters a bridge between technically-oriented young people who are exploring career options and new car dealers who urgently need talented technicians. In addition to taking the academic courses that are required in order to earn their high school degrees, students take challenging classroom/laboratory courses in basic automotive technology. The capstone of GNYADA’s AYES Program is a 320- hour workplace internship. NADA ISSUES NEW COMPLIANCE GUIDE ON FEDERAL ADVERTISING RULES

The National Automobile Dealers Association’s (NADA) Dealer Guide to Federal Advertising Requirements assists new car dealers in complying with federal advertising requirements on the sale, financing, and leasing of automotive products and services. The publication provides examples of “bad” and “good” ads as well as chapters on 41 different federal advertising topics, such as the use of discount claims, email advertising, green marketing claims, Internet advertising, satisfaction guarantees, and trigger terms. This guide is an invaluable resource, particularly considering the Federal Trade Commission’s continued scrutiny of dealer compliance with federal advertising standards. Since 2012, the FTC has initiated nine separate rounds of advertising enforcement actions against 27 dealers in 17 states for multiple advertising violations, including actions against three dealers that the FTC announced last December. “The guide does not address additional advertising requirements that may be imposed at the state or local level, which vary considerably and need to be fully addressed when dealer ads are reviewed for legal compliance,” said Paul Metrey, NADA Chief Regulatory Counsel. “It’s essential that dealers consult with their legal counsel to determine – and to ensure that their advertisements are consistent with – the full scope of their advertising responsibilities.” The guide is part of NADA’s Management Series, “Driven.”It is available at www.nada.org .

ATTORNEY GENERAL’S ADVERTISING GUIDELINES FOR NEW CAR DEALERSHIPS

Except for the purchase of a home, the purchase of an automobile represents the most expensive consumer transaction most NewYorkers will undertake. In deciding upon such a purchase, NewYork consumers have a legal right to automobile advertising that is free from deception. This office’s review of current car ads has revealed a widespread pattern of deception and the use of materially false or misleading representations by some dealers. Rather than truthfully informing consumers, all too many ads appear designed primarily to confuse and mislead them. Such unscrupulous dealer ads are costly traps for unwary car buyers and are unfair to those dealers who compete on the basis of forthright and truthful advertising. In response to this pattern of consumer fraud, the Attorney General directed his staff to undertake a statewide review to determine the nature and extent of existing deceptive automobile advertising by dealers and to adopt Advertising Guidelines for the benefit of the public and the industry. In the course of its work, the Attorney General’s staff closely examined a substantial number of dealer ads, consulted the laws, regulations and guidelines of other states, and reviewed consumer complaints and prior enforcement actions by this office. The views of the NewYork State Department of Motor Vehicles and automobile dealer associations across the state were elicited and carefully considered.

These associations included the Greater New York Automobile Dealers Association, the New York State Automobile Dealers Inc., the Capital District Automobile Dealers Association, the Niagara Frontier Automobile Dealers Association, the Rochester Automobile Dealers Association and the Syracuse Automobile Dealers Association. The Advertising Guidelines for Auto Dealers, developed by the Attorney General’s office as a result of this extensive inquiry, are intended to articulate the enforcement policy of this office: to set forth, with some specificity, what practices are deemed by the Attorney General to be prohibited under New York State’s laws governing false advertising and deceptive business practices, statutes which this office enforces.

Enforcement action by the Attorney General’s office in the area of advertising is based primarily on three consumer protection statutes: Executive Law §63(12), General Business Law Article 22A (§350), and General Business Law §396. These statutes, however, do not specifically enumerate proscribed advertising practices; they contain general prohibitions against false, deceptive or bait and switch advertising. The guidelines are intended to clarify that certain dealer advertising practices will be considered a violation of these consumer protection laws and may lead to enforcement action. These guidelines are intended to serve both the public and the dealers. The public from non-deceptive advertising which provides a reliable basis for comparison between competitors; dealers will be served by the fostering of
